Laytime & Demurrage Disputes
This is one of the most common causes for disputes, which could often be avoided by a clear and carefully drafted contract. We assist ship-owners and charterers to calculate laytime, demurrage and dispatch.
Cargo Contamination, Loss or Shortage of Cargo
We represent both ship-owners and charterers, and their P&I clubs, in disputes of cargo contamination and loss or shortage of cargo. We have long lasting relationships with the main surveyors in the Middle East and can advise our clients of the most suitable technical expertise for their claim. Even if we instruct surveyors we supervise the claims development closely.
Freight & Off-hire Disputes
Even though most freight and off-hire disputes can be avoided by a carefully drafted contract, disputes do occur. We assist with freight calculations, etc.
Bunker Issues
Bunker disputes are quite common. Whether it is the quality, the quantity, the title to it or to recover payment for it, we assist on drafting the contracts and advise on the legal situation. One question that frequently arises is who is responsible for the quality of the bunker and any consequential losses due to faulty bunkers.
FD&D
One largely available form of protection offered from Clubs to their Members, this form of insurance covers the cost for legal advice in disputes that may arise out of a charterparty. This type of insurance encounters limits in the usual form offered by P&I Clubs and put the Insured in an effort to prove that his case has merit, loosing precious time in the meanwhile. Fichte & Co now offer this very same form of legal protection to all the ship operators without such limits.
