Fichte & Co have been instructed to defend the claim initiated by a seller under an MOA against an alleged buyer viz London arbitration. The dispute involves litigation on the identity of the buyer, agency issues and misrepresentation by the brokers, including return of the deposit paid under clause 2 of the NSF93.

The Firm is presently involved in the enforcement of two London awards issued under the LMAA terms. Fichte & Co are aggressively pursuing this ongoing case before the Fujairah and Dubai Courts and have so far successfully avoided all the preliminary issues raised by the judge in connection with alternative practices.

In ongoing litigation for an international client, Fichte & Co have successfully arrested a vessel on behalf of her managers in two different times and in two different jurisdictions. The merits of the case concern unpaid management fees and the first arrest was withdrawn when a settlement agreement was executed between the parties. Upon breach of the settlement terms we have been instructed to re-arrest the vessel now moving to a different jurisdiction and we have done so successfully defending the arrest till the Supreme Court.

Fichte & Co are representing Owners in a charterparty dispute in the DIFC-LCIA Arbitration Centre. The case stems from unpaid mobilization charges and off-hire deductions, and involves contradictory “Additional Agreed Terms” and their interpretation and application.
